Almost every employer will at some stage be placed in the regrettable position where they must terminate an employee’s employment with their business.

While in many cases the termination of employment may be by agreement there are times where an employer will have to make the decision to terminate an employee’s employment for another reason. Employers must be careful to ensure that any termination is for a legally potentially fair reason and in accordance with current employment law otherwise it may give rise to claims of wrongful dismissal, unfair dismissal, or both.
