Dangerous Driving


Dangerous driving is a serious offence that may result in a custodial sentence. It should not be confused with careless driving. It is vital to take advice as early as possible if you have been or think that you might be charged with this offence.

For a dangerous driving charge to result in a conviction the prosecution must show that the standard of driving was ‘far below’ that which would be expected of a competent and careful driver AND that it would be obvious to a competent and careful driver that driving in that way would be dangerous. Alternatively it can be the case that the dangerous driving is a result of the condition of the vehicle.
