Dangerous driving is a serious offence that may result in a custodial sentence. It should not be confused with careless driving
. It is vital to take advice as early as possible if you have been or think that you might be charged with this offence.
For a dangerous driving charge to result in a conviction the prosecution must show that the standard of driving was ‘far below’ that which would be expected of a competent and careful driver AND that it would be obvious to a competent and careful driver that driving in that way would be dangerous. Alternatively it can be the case that the dangerous driving is a result of the condition of the vehicle.
